Terms & Conditions

Vest Construction Inc. — Effective July 1, 2026

  1. 1. Agreement

    By approving this estimate or signing a Work Authorization, the property owner ("Client") agrees to these Terms and Conditions and authorizes Vest Construction Inc. ("Contractor") to perform the described work.

  2. 2. Payment

    A deposit is required before materials are ordered or work begins. Insurance restoration jobs are billed in stages aligned to insurance claim payments. Retail jobs require a deposit at contract signing and final balance upon completion. Returned checks are subject to a $35 fee. Accounts unpaid after 30 days accrue interest at 1.5% per month.

  3. 3. Insurance Claims

    Client authorizes Contractor to communicate with their insurance carrier regarding the approved scope of work. Client remains responsible for their deductible. Contractor does not waive, absorb, or discount deductibles. Approved supplements are included in the project scope.

  4. 4. Materials & Substitutions

    Contractor will use materials specified in the estimate. If specified materials are unavailable, Contractor will substitute equal or better materials and notify Client prior to installation.

  5. 5. Scope Changes

    Any changes to the approved scope of work must be authorized in writing via a signed Change Order before additional work begins. Change Orders may affect price and timeline.

  6. 6. Timeline

    Project start and completion dates are estimates. Delays caused by weather, material availability, permit processing, or insurance carrier timelines are beyond Contractor's control and do not constitute breach of contract.

  7. 7. Access & Site Conditions

    Client agrees to provide safe, unobstructed access to the work area. Contractor is not responsible for pre-existing damage, code violations discovered during work, or damage resulting from conditions unknown at time of estimate.

  8. 8. Permits

    Contractor will obtain required permits where applicable. Permit fees are included in the estimate unless otherwise noted. Client is responsible for HOA approvals where required.

  9. 9. Debris & Cleanup

    Contractor will remove all project-related debris upon completion. Client is responsible for removing personal property from the work area prior to start date. Contractor is not liable for damage to items left in the work area.

  10. 10. Subcontractors

    Contractor may use licensed, insured subcontractors to perform portions of the work. All subcontractors are required to carry general liability insurance and provide a current Certificate of Insurance.

  11. 11. Insurance & Liability

    Contractor carries general liability insurance. Contractor is not responsible for damage caused by pre-existing structural deficiencies, Acts of God, or conditions not visible at time of inspection. Client's homeowner's insurance remains primary for property damage not caused by Contractor's negligence.

  12. 12. Warranty

    Contractor warrants all workmanship for a period of one (1) year from the date of project completion. Manufacturer material warranties apply per manufacturer terms. Warranty is void if damage results from Client modification, improper maintenance, or acts outside Contractor's control.

  13. 13. Cancellation

    Client may cancel prior to material delivery with written notice. If materials have been ordered, Client is responsible for actual material costs incurred. Work Authorizations signed for insurance jobs are binding upon adjuster approval.

  14. 14. Dispute Resolution

    Any dispute arising from this agreement shall first be subject to good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Cherokee County, Georgia under Georgia law.

  15. 15. Entire Agreement

    These Terms, together with the signed estimate or Work Authorization, constitute the entire agreement between the parties. Oral representations not reflected in writing are not binding.
